These Terms and Conditions ("Terms") govern your use of the website located at farmingtonconcretecompany.com (the "Site") and any services provided by Farmington Concrete ("we," "us," or "our"). By accessing the Site or engaging our services, you agree to these Terms in full. If you do not agree, please do not use the Site or our services.
By using the Site or requesting a service estimate, you confirm that you are at least 18 years old, are legally able to enter into a binding agreement, and accept these Terms. We reserve the right to update these Terms at any time. The effective date at the top of this page will reflect the date of the most recent revision. Continued use of the Site or our services after any change constitutes acceptance of the updated Terms.
Farmington Concrete is a concrete contractor based in Farmington, NM. We provide concrete installation, construction, and related services for residential and commercial customers. Services are offered in Farmington and surrounding communities. We do not guarantee availability in all locations, and we reserve the right to decline any project at our discretion.
All written estimates are provided at no charge and are based on an in-person inspection of the project site. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Estimates are based on site conditions observed at the time of the visit. If unforeseen conditions are discovered once work begins - such as buried utilities, unstable soil, or hidden structural issues - the project cost may be adjusted. We will notify you of any material change before proceeding.
All pricing is in U.S. dollars. Prices do not include applicable permit fees unless expressly stated in the written estimate.
Project start dates are subject to weather conditions, permit timelines, crew availability, and material delivery schedules. We will provide you with a projected start date once a signed agreement and required deposit are received. Start dates are estimates, not guarantees.
If you need to cancel a scheduled project, please notify us in writing as soon as possible. Cancellations made before work begins may be subject to a fee to cover permit costs and mobilization expenses already incurred, as specified in your written agreement.
We reserve the right to reschedule or suspend work due to weather conditions that would compromise the quality of the finished product, including extreme heat, freezing temperatures, and active precipitation.
Payment terms will be stated in your written project agreement. Typically, a deposit is required before work begins, with the remaining balance due upon project completion. We accept payment by check, cash, or other methods specified in the agreement.
If any amount owed is not paid when due, we reserve the right to suspend work, charge interest on the outstanding balance at the maximum rate permitted by New Mexico law, and pursue collection through available legal remedies.

We are not responsible for damage to unmarked underground utilities, irrigation lines, or other buried features that were not disclosed to us prior to work beginning.
We warrant that our services will be performed in a workmanlike manner consistent with industry standards for concrete work inNew Mexico. Any warranty terms specific to your project will be stated in your written agreement.
The following conditions are excluded from any warranty and are considered normal characteristics of concrete:
The Site and all content on it are provided "as is" without warranties of any kind, express or implied.
To the fullest extent permitted by New Mexico law, our total liability for any claim arising from our services or from use of the Site will not exceed the total amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages of any kind, including but not limited to loss of use, loss of income, or property damage beyond the direct work area, even if we were advised of the possibility of such damages.
If a dispute arises from these Terms or from any services we provide, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue resolution through mediation or binding arbitration in San Juan County, New Mexico, before filing any lawsuit.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction when necessary to prevent irreparable harm.
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration under Section 9 will be brought exclusively in the state or federal courts located in San Juan County, New Mexico.
All content on the Site - including text, images, logos, and layout - is owned by or licensed to Farmington Concrete. You may not copy, reproduce, or distribute any content from the Site without our prior written permission.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Site and contact us to discuss any ongoing service agreements.
